By accessing, browsing, or utilizing any Homes Remodeling Care services, website features, or mobile applications in any capacity, you acknowledge that you have carefully read, fully understood, and unconditionally agree to be legally bound by all provisions within these Terms and Conditions. If you do not fully agree with any single provision herein, please immediately discontinue all use of our services and platforms.
All remodeling and installation services provided by Homes Remodeling Care are exclusively governed by a formal written contract specifying the complete project scope, selected materials, agreed timeline, and comprehensive payment schedule. Absolutely no work commences without a properly executed signed agreement. Any requested modifications to the original project scope require a formal written change order that must be reviewed, approved, and co-signed by authorized representatives of both parties before implementation.
Standard payment is structured as a 25% deposit due upon contract signing, 25% due at the confirmed project midpoint milestone, and the remaining 50% due upon satisfactory final completion and client acceptance. Payments outstanding beyond 15 calendar days will incur a compounding 1.5% monthly interest charge on the unpaid balance. Persistent non-payment may result in immediate project suspension until all outstanding balances are fully resolved.
Homes Remodeling Care provides a comprehensive five-year workmanship warranty covering all defects in completed labor quality and installation standards on every project we undertake. This warranty specifically excludes any damage resulting from improper client maintenance practices, negligent misuse, acts of nature or extreme weather events, or unauthorized modifications made by unqualified third parties following the official completion and handover of the project to the client.
Cancellation requests submitted within 72 hours of initial contract signing are eligible for a complete, unconditional deposit refund. Cancellations requested after project work has formally commenced will be subject to charges covering all work completed to date plus all materials already ordered or purchased. Homes Remodeling Care reserves the right to terminate projects due to persistently unsafe working conditions, permit denials, or continued non-payment by the client.
All design concepts, architectural renderings, detailed construction plans, website content, logos, trademarks, and all other creative materials developed by Homes Remodeling Care remain our exclusive intellectual property until full contracted payment is received and cleared. Any unauthorized reproduction, redistribution, public display, or commercial exploitation of our designs and proprietary content without prior written permission is strictly prohibited and may result in immediate civil legal action.
Homes Remodeling Care maximum total liability arising from any and all claims connected to our services shall not exceed the total net amount paid by the client for the specific individual project in question. Under no circumstances shall we bear liability for indirect, incidental, consequential, special, or punitive damages of any nature, including but not limited to loss of use of property, lost business profits, or property damage arising from circumstances beyond our reasonable direct operational control.
Clients bear full responsibility for ensuring safe, unrestricted site access throughout the project duration, securing all personal valuables and sensitive items, obtaining any required HOA or neighborhood association approvals prior to project start, proactively disclosing all known hazardous materials on the property, and providing fully accurate and complete property information. Failure to meet these responsibilities may directly result in project delays, additional unforeseen costs, or formal contract termination.
Any disputes, claims, or controversies arising from Homes Remodeling Care services or these Terms shall first be addressed through a mandatory 30-day good-faith direct negotiation period. If the dispute remains unresolved after this period, it shall proceed to binding arbitration administered under the American Arbitration Association's Construction Industry Rules in Travis County, Texas. Both parties explicitly and irrevocably waive any right to class action lawsuits or jury trials.
These Terms and Conditions and all associated agreements are exclusively governed by and interpreted in accordance with the laws of USA, without giving effect to any conflict of law provisions or principles.
